      Hi All,

      Just posting on here as I’m divorcing my husband (emotional abuse) but he’s refusing to leave. I’ve got a non-mol order against him which he’s repeatedly breaching – harassing me verbally. (detail removed by moderator) I plan to report his breach of order to the police and I’ve attended my local domestic abuse centre and am waiting to get assigned to a support worker.

      Question is how do I get him out – the kids and I cannot live like this any more. I own the house and do not want to uproot the kids. He can afford to privately rent but won’t go. What else can I do?

      Hi TotallyFedUp, This sounds a really miserable situation. I know lots of ladies on this forum have experienced this waiting for the divorce to be finalised. It’s an awful situation to live in.

      Get some legal advice on the divorce, finances and your chances of getting him to leave. In a divorce situation, it doesn’t matter that much who actually owns the house. A family home is considered such an important asset that its value can be divided irrespective of who owns it, or contributed to it. Obviously the fact that you have children may change the financial split but only a solicitor can advise you on what that is likely to be. Look for a solicitor who does family law. Some offer the first 30 minutes free in some areas. Have a list of everything ready so you don’t waste any time. You can also try Rights of Women Family Law helpline. They are only open limited hours and it is v hard to get through, but worth persevering as they are very helpful. Good luck with it all.
