ParticipantHi has anyone else had issues with their GP declining to do the legal aid letter because the it states “domestic violence” rather than abuse. My GP refers to the term violence as only physical abuse but because I suffered emotional and controlling abuse, she will not do the letter, so I’m stuck in this awful situation of my ex wanting a divorce, financial settlement and child access and I can not afford legal representation. Since separating he has bullied over getting his name off the mortgage, access to our daughter and I fall to pieces with the least little bit of communication from him. I need a solicitor to be a go between and get things in place so I can move on.
Starting to feel desperate now!!!

I got legal aid. My solicitor applied for it. I didn’t need a letter just my payslip x

How long ago was this? As you can only get legal aid if there’s domestic abuse now and on low income. -

ParticipantIt really grinds my gears when people (especially professionals) try to grade abuse. There’s this terrible assumption that emotional/psychological abuse is less damaging than physical abuse which is utter bull faeces!
Is there another GP you could try? Is there a practice manager?

ParticipantMy doctor said that she’s approached the practice leaders and still won’t do the letter. My solicitor is going to email my GP but I’m not very hopeful.

If yo0ur gp wont do the letter, did u ever report ex to police for abuse and press charges, thats another way i thrink u can fallinto criterai fro legal aid or apply for a non mol

ParticipantHi No I never reported him to the police although on a few times came close, but due to his profession I felt I couldn’t contact the police. Plus I guess when your living with emotional abuse you on’t realise until after the event.

ParticipantHi. Have you looked at GOV.UK website? Look up (sorry don’t know how to post link properly) http://www.gov.uk/government/publications/get-medical-proof-of-domestic-violence, for a sample letter you can write to your GP that defines domestic violence as a pattern of behaviour that can include violence. Your GP does not seem to be up to date on this issue (worrying). Your solicitor might be able to explain it to your GP. I noticed you will have needed to have seen your GP in the last 5 years with a complaint that you can state was related to the domestic abuse you have suffered. Don’t know if this will help. Take care.

hope you are getting this resolved now, I couldn’t get legal aid and ended up getting credit cards to fund my divorce which I wouldn’t recommend as it means thousands of pounds have to come out of the pot at the end I my ex may not have to contribute to what I have actually paid. Honestly that GP is terrible. -

Blockedyour gp can still write a letter referring to “domestic abuse” or “emotional abuse” however given her attitude towards you doubt she will do this for you… you can get a similar letter from DACS or other counsellor. doesnt have to be your gp and quite often GPs dont deal with this anyway – they refer you elsewhere.
a word of warning – it is harder and harder to not only get legal aid, but to KEEP IT going – mine was axed just a month before the final hearing – I had run out of funding but nobody bothered to tell me until last minute đ your ex may also purposely try to exhaust your legal aid as fast as he can so you dont have funds for the hearing – beware of this tactic by some of these men – tell any solicitor NOT to do anything until the court hearing (to not reply to his letters, emails, etc)
if you can, try looking to get a Direct Access Barrister rather than use a firm. this way you are still represented at court, but you dont pay huge fees although still cost around ÂŁ1500 for a full days’ hearing, but you can represent yourself at the other “lesser” hearings (directions, etc). you can also get a McKenzie friend, however this is normally used by these men
it always astonishes me how females – a this time a GP – can be harsher than males when you allege DV ans refuse to help, you will also find this with some court magistrates and judges so heads up there

ParticipantHi an update (detail removed by moderator), very surprised but I can move forward and finally get some progress not just for my sanity but also my daughters. Thank you for all your replies and support. Hopefully my story will help others not give up on getting the help they need.
