What constitutes rape?

  I’m curious as to what constitutes rape? Does it have to include penetration? Does the penetration have to have been the Penis?
  
  Sorry for asking this, I don’t want to upset anyone who has been through this and will explain why soon,

  Police told me this is assault by penetration wheras rape is with his bits.

  without consent. Consent must be freely and clearly given. If a person is asleep/unconscious (e.g.drugged) they cannot consent.

  A person commits rape if they intentionally penetrate the vagina, a**s or mouth of another person with their penis without consent.
