      He is not at the address anymore and will not be returning, am looking to eventually issue non mol but in meantime as he’s still on tenancy how can I get him removed? Can anyone recommend where I can legal advice for this? I’m on legal aid atm with my solicitor but need to ask about where the deposit goes and if it can be used by me to secure new tenancy particularly as children still live with me.

      Hi, your solicitor is the person to ask.
      If he is on the tenancy he has the right to return as he has a right to occupy.

      There is a difference depending on whether you are married or not. You are more protected if you are married. If you are not married then it may be just property rights so the deposit may be either equally split if it’s all joint or belongs to the person who paid it if that’s what has been set out in writing. Your solicitor can advise you depending on what your actual circumstances are.

      You might also find it helpful to speak to Shelter for some advice, if your solicitor isn’t sure. They’re the experts in housing law and should be able to answer any of your questions.
